The Triangle Shirtwaist Factory fire in New York City on March 25, 1911, was the deadliest industrial disaster in the history of the city of New York and resulted in the fourth highest loss of life from an industrial accident in U.S. history. The fire caused the deaths of 146 garment workers, who either died from the fire or jumped to their deaths. Most of the victims were recent immigrant Jewish and Italian women aged sixteen to twenty-three.^[1]^[2]^[3] Many of the workers could not escape the burning building because the managers had locked the doors to the stairwells and exits. People jumped from the eighth, ninth, and tenth floors. The fire led to legislation requiring improved factory safety standards and helped spur the growth of the International Ladies' Garment Workers' Union, which fought for better working conditions for sweatshop workers.

The factory was located in the Asch Building, at 29 Washington Place, now known as the Brown Building, which has been designated a National Historic Landmark and a New York City landmark.^[4]

Fire

The Triangle Waist Company^[5] factory occupied the eighth, ninth, and tenth (top-most) floors of the Asch Building on the northwest corner of Greene Street and Washington Place, just to the east of Washington Square Park, in the Greenwich Village area of New York City. Under the ownership of Max Blanck and Isaac Harris, the factory produced women's blouses, known as "shirtwaists." The factory normally employed about 500 workers, mostly young immigrant women, who worked nine hours a day on weekdays plus seven hours on Saturdays.^[6]

As the workday was ending on the afternoon of Saturday, March 25, 1911, a fire flared up at approximately 4:45 PM^[7] in a scrap bin under one of the cutter's tables at the northeast corner of the eighth floor.^[8] Both owners of the factory were in attendance and had invited their children to the factory on that afternoon.^[9] The Fire Marshal concluded that the likely cause of the fire was the disposal of an unextinguished match or cigarette butt in the scrap bin, which held two months' worth of accumulated cuttings by the time of the fire.^[10] Although smoking was banned in the factory, cutters were known to sneak cigarettes, exhaling the smoke through their lapels to avoid detection.^[11] A New York Times article suggested that the fire may have been started by the engines running the sewing machines, while The Insurance Monitor, a leading industry journal, suggested that the epidemic of fires among shirtwaist manufacturers was "fairly saturated with moral hazard."^[9] No one suggested arson.

A bookkeeper on the eighth floor was able to warn employees on the tenth floor via telephone, but there was no audible alarm and no way to contact staff on the ninth floor.^[12] According to survivor Yetta Lubitz, the first warning of the fire on the ninth floor arrived at the same time as the fire itself.^[13] Although the floor had a number of exits – two freight elevators, a fire escape, and stairways down to Greene Street and Washington Place – flames prevented workers from descending the Greene Street stairway, and the door to the Washington Place stairway was locked to prevent theft. The foreman who held the stairway door key had already escaped by another route.^[14] Dozens of employees escaped the fire by going up the Greene Street stairway to the roof. Other survivors were able to jam themselves into the elevators while they continued to operate.

Within three minutes, the Greene Street stairway became unusable in both directions.^[15] Terrified employees crowded onto the single exterior fire escape, a flimsy and poorly-anchored iron structure which may have been broken before the fire. It soon twisted and collapsed from the heat and overload, spilling victims nearly 100 feet (30 m) to their deaths on the concrete pavement below. Elevator operators Joseph Zito^[16] and Gaspar Mortillalo saved many lives by traveling three times up to the ninth floor for passengers, but Mortillalo was eventually forced to give up when the rails of his elevator buckled under the heat. Some victims pried the elevator doors open and jumped down the empty shaft. The weight of these bodies made it impossible for Zito to make another attempt.

A large crowd of bystanders gathered on the street, witnessing sixty-two people jumping or falling to their deaths from the burning building.^[17] Louis Waldman, later a New York Socialist state assemblyman, described the scene years later:^[18]

One Saturday afternoon in March of that year — March 25, to be precise — I was sitting at one of the reading tables in the old Astor Library... It was a raw, unpleasant day and the comfortable reading room seemed a delightful place to spend the remaining few hours until the library closed. I was deeply engrossed in my book when I became aware of fire engines racing past the building. By this time I was sufficiently Americanized to be fascinated by the sound of fire engines. Along with several others in the library, I ran out to see what was happening, and followed crowds of people to the scene of the fire.
A few blocks away, the Asch Building at the corner of Washington Place and Greene Street was ablaze. When we arrived at the scene, the police had thrown up a cordon around the area and the firemen were helplessly fighting the blaze. The eighth, ninth, and tenth stories of the building were now an enormous roaring cornice of flames.
Word had spread through the East Side, by some magic of terror, that the plant of the Triangle Waist Company was on fire and that several hundred workers were trapped. Horrified and helpless, the crowds — I among them — looked up at the burning building, saw girl after girl appear at the reddened windows, pause for a terrified moment, and then leap to the pavement below, to land as mangled, bloody pulp. This went on for what seemed a ghastly eternity. Occasionally a girl who had hesitated too long was licked by pursuing flames and, screaming with clothing and hair ablaze, plunged like a living torch to the street. Life nets held by the firemen were torn by the impact of the falling bodies.
The emotions of the crowd were indescribable. Women were hysterical, scores fainted; men wept as, in paroxysms of frenzy, they hurled themselves against the police lines.

The remainder waited until smoke and fire overcame them. The fire department arrived quickly but was unable to stop the flames, as there were no ladders available that could reach beyond the sixth floor. The fallen bodies and falling victims also made it difficult for the fire department to approach the building.

Aftermath

Although early references of the death toll ranged from 141^[19] to 148,^[20] almost all modern references agree that 146 people died as a result of the fire; 129 women and 17 men.^[21]^[22]^[23]^[24]^[25]^[26]^[27] Six victims remained unidentified until 2011.^[28]^[21] Most victims died of burns, asphyxiation, blunt impact injuries, or a combination of the three.^[29]

The first person to jump was a man, and another man was seen kissing a young woman at the window before they both jumped to their deaths.^[30]

Twenty-two victims of the fire were buried by the Hebrew Free Burial Association in a special section at Mount Richmond Cemetery. In some instances, their tombstones refer to the fire.^[31] The six victims who remained unidentified were buried together in the Cemetery of the Evergreens in Brooklyn. Originally interred elsewhere on the grounds, their remains now lie underneath a monument to the tragedy, a large marble slab featuring a kneeling woman.^[32] The six unknown victims were identified in February 2011.^[21]

Consequences

The company's owners, Max Blanck and Isaac Harris, who survived the fire by fleeing to the building's roof when the fire began, were indicted on charges of first and second degree manslaughter in mid-April; the pair's trial began on December 4, 1911.^[33]Max Steuer, counsel for the defendants, managed to destroy the credibility of one of the survivors, Kate Alterman, by asking her to repeat her testimony a number of times — which she did without altering key phrases. Steuer argued to the jury that Alterman and possibly other witnesses had memorized their statements, and might even have been told what to say by the prosecutors. The defense also stressed that the prosecution had failed to prove that the owners knew the exit doors were locked at the time in question. The jury acquitted the two men, but they lost a subsequent civil suit in 1913 in which plaintiffs won compensation in the amount of $75 per deceased victim. The insurance company paid Blanck and Harris about $60,000 more than the reported losses, or about $400 per casualty. In 1913, Blanck was once again arrested for locking the door in his factory during working hours. He was fined $20.^[34]

Rose Schneiderman, a prominent socialist and union activist, gave a speech at the memorial meeting held in the Metropolitan Opera House on April 2, 1911, to an audience largely made up of the members of the Women's Trade Union League. She used the fire as an argument for factory workers to organize:

I would be a traitor to these poor burned bodies if I came here to talk good fellowship. We have tried you good people of the public and we have found you wanting. ... We have tried you citizens; we are trying you now, and you have a couple of dollars for the sorrowing mothers, brothers and sisters by way of a charity gift. But every time the workers come out in the only way they know to protest against conditions which are unbearable the strong hand of the law is allowed to press down heavily upon us.
Public officials have only words of warning to us--warning that we must be intensely peaceable, and they have the workhouse just back of all their warnings. The strong hand of the law beats us back, when we rise, into the conditions that make life unbearable.
I can't talk fellowship to you who are gathered here. Too much blood has been spilled. I know from my experience it is up to the working people to save themselves. The only way they can save themselves is by a strong working-class movement.^[35]

Others in the community, and in particular in the ILGWU,^[36] drew a different lesson from events. The New York State Legislature created its New York State Factory Investigating Committee to "investigate factory conditions in this and other cities and to report remedial measures of legislation to prevent hazard or loss of life among employees through fire, unsanitary conditions, and occupational diseases."^[37] New York City's Fire Chief John Kenlon told the investigators that his department had identified more than 200 factories where conditions made a fire like that at the Triangle Factory possible.^[38] The State Committee's 1915 report helped modernize the state's labor laws. It made New York State "one of the most progressive states in terms of labor reform."^[39] As a result of the fire, the American Society of Safety Engineers was founded in New York City on October 14, 1911.^[40]

Centennial

A coalition of preservation organizations, historians, artists, and labor activists, including the Greenwich Village Society for Historic Preservation, theGotham Center, the Lower East Side Tenement Museum, the Bowery Poetry Club and others, came together to form the Remember the Triangle Fire Coalition,^[41] whose goal is to commemorate the centennial of the fire, which will take place in 2011.

Presidential Proclamation--100th Anniversary of the Triangle Shirtwaist Factory Fire

On March 25, 1911, a fire spread through the cramped floors of the Triangle Shirtwaist Factory in lower Manhattan. Flames spread quickly through the 8th, 9th, and 10th floors -- overcrowded, littered with cloth scraps, and containing few buckets of water to douse the flames -- giving the factory workers there little time to escape. When the panicked workers tried to flee, they encountered locked doors and broken fire escapes, and were trapped by long tables and bulky machines. As bystanders watched in horror, young workers began jumping out of the windows to escape the inferno, falling helplessly to their deaths on the street below.

By the time the fire was extinguished, nearly 150 individuals had perished in an avoidable tragedy. The exploited workers killed that day were mostly young women, recent immigrants of Jewish and Italian descent. The catastrophe sent shockwaves through New York City and the immigrant communities of Manhattan's Lower East Side, where families struggled to recognize the charred remains of their loved ones in makeshift morgues. The last victims were officially identified just this year.

A century later, we reflect not only on the tragic loss of these young lives, but also on the movement they inspired. The Triangle factory fire was a galvanizing moment, calling American leaders to reexamine their approach to workplace conditions and the purpose of unions. The fire awakened the conscience of our Nation, inspiring sweeping improvements to safety regulations both in New York and across the United States. The tragedy strengthened the potency of organized labor, which gave voice to previously powerless workers. A witness to the fire, Frances Perkins carried the gruesome images of that day through a lifetime of advocacy for American workers and into her role as the Secretary of Labor and our country's first female Cabinet Secretary.

Despite the enormous progress made since the Triangle factory fire, we are still fighting to provide adequate working conditions for all women and men on the job, ensure no person within our borders is exploited for their labor, and uphold collective bargaining as a tool to give workers a seat at the tables of power. Working Americans are the backbone of our communities and power the engine of our economy. As we mark the anniversary of the Triangle Shirtwaist Factory Fire, let us resolve to renew the urgency that tragedy inspired and recommit to our shared responsibility to provide a safe environment for all American workers.

NOW, THEREFORE, I, BARACK OBAMA, President of the United States of America, by virtue of the authority vested in me by the Constitution and the laws of the United States, do hereby proclaim March 25, 2011, as the 100th Anniversary of the Triangle Shirtwaist Factory Fire. To walk by it now, it's just another building off New York City's Washington Square, part of the Greenwich Village campus of New York University. But from the ashes of a fire that once consumed its top floors, history was made. Michelle Miller offers this remembrance:

It was late in the afternoon on a beautiful spring Saturday - March 25, 1911 - 4:40 p.m., to be exact.

It was nearly quitting time at the Triangle Shirtwaist Factory in New York's Greenwich Village, where 500 workers, mostly young Italian and Jewish women and girls, got ready to collect their pay, and go home.

Someone dropped a match, or a cigarette ... and within minutes the factory, which occupied the top three floors of a 10-story building, became an inferno.

Fire ladders, which reached only 6 floors up, were useless. The fire escape collapsed under the weight of desperate workers trying to escape.

One of the doors, it would be reported, was locked.

Onlookers, out for a weekend stroll in nearby Washington Square Park, watched in horror as women leapt to their deaths from upper-story windows , some crashing through the firemen's nets, others hitting the sidewalk with a sickening thud.

That terrible day 100 years ago was almost a mirror of 9/11, said Michelle Miller.

"In some ways it was," said researcher Michael Hirsch. "The horror of the fire, jumping the way they did. It was more intimate, though. You could look into their faces, see the expression on their face in their last moments, hear them hit the pavement that way."

In the days that followed, family members crowded into a makeshift morgue, trying, sometimes in vain, to identify those they lost among the charred remains.

On that day, says Hirsch, all of New York was united in grief.

"This fire really shook people up," he told Miller. "The city was so guilt-stricken. Everyone knew something was wrong, there was something wrong with that building and that maybe we were somehow responsible. And it led to all these reforms that came after."

The fire led to a 2-year investigation of factory conditions, and laws which would revolutionize the American workplace.

Out of the ashes of the Triangle fire came new safety and fire regulations ... child labor laws ... and workman's compensation.

The outpouring of support for working people galvanized the fledgling American labor movement .

Frances Perkins - who witnessed the horror of that awful day, and went on to become a crusading reformer and FDR's Secretary of Labor - called it "the day the New Deal began."

One hundred years later, there are tributes and remembrances of all kinds - even as the country is locked in ferocious debate about the value of unions today, and the need for regulation.

Hirsch, co-producer of an HBO documentary on the Triangle Fire, said, "I thought it was important to remind people about why we made the changes we did along the way."

He showed Miller the union monument to the Triangle.

But he worries that memories of that day and its repercussions are fading - like the names on graves at Mt. Zion cemetery in Queens.

"It's getting hard to read even the large inscriptions on here," Hirsch said.

Like Celia Giltin's. "You used to be able to read this," Hirsch said. "You could clearly see '17 years old' on this. But it's just melting away. And in a way it's almost a metaphor for the way we're forgetting these people and what they did for us."

For the last five years, Hirsch has made it his mission - his obsession, really - to find the names of all 146 people who died in the fire that day, and their stories, and to care for their graves, and their memories.

"I just felt I owed it to them somehow," Hirsch said. "They lost everything. For them to lose their names as well, that just seemed wrong."

Some of the Triangle fire's victims family members don't even know. "Often I'm bringing them for the first time, this news, believe it or not," said Hirsch.

Erica Lansner didn't even know her great aunt's name, until she got a call from Hirsch.

"I always remember my dad telling us that he had an aunt who died in the fire, but that is all I remember," Lantzer said.

Almost a century after the fact, Erica Lansner discovered that her 21-year-old aunt, Fanny Lansner, was a hero that day, saving the lives of many of her coworkers, before jumping to her own death.

"Just to think of a 21-year-old, knowing that she had minutes to live and chose to put others ahead of herself is just extraordinary," Erica said. "I feel actually quite proud to be her descendant."

Artist Elizabeth Wilson recalls her father telling her, "Grandpop's brother Joseph died in the fire."

The 100th anniversary is a chance to learn about her uncle, Joseph Wilson, and his fiancý, Rosie Solomon, who identified Joseph by his pocket watch.

"She asked the attendant about the pocket watch, they opened it up, and there was her picture, staring," Elizabeth said. "I kind of just felt this heaviness like, oh ...'Cause you realize the pain."

Essie Bernstein also died in the fire. She was a relative of factory owner Max Blancke, who (along with his partner Isaac Harris) has gone down in history as the man who locked the factory doors - some say to keep out union organizers after a bitter strike.

Their acquittal by a jury caused outrage then, and still rankles today.

"They're not saints, Harris and Blancke," said Hitrsch. "There was a lot wrong with that factory."

In truth, though, said Hirsch, the Blancke family suffered, too. "The Blancke family lost more people in the Triangle that any other family. No one really knows this. It's just been kept out of the histories," Hirsch said. "You start to humanize these people and start to tell their stories differently."

Susan Harris, the granddaughter of Max Blancke, said it's important to remember and honor the victims. Growing up, she says, she knew nothing of the Triangle Fire. Her family moved to California, and changed the spelling of their name. When she was a teenager, she came across a book, and a name that looked familiar ...

"I remember turning to my mom , and I said, 'Was this Max Blancke, was this my grandfather?' And she said, 'Yes, but that happened a long time ago. You don't have to worry about that.'

"It wasn't something that people wanted to talk about. It was too painful," she said.

Susan Harris has spent the last five years remembering the fire, and its victims ... by stitching the names of the dead, including her own relatives, onto pieces of old shirtwaist fabric and handkerchiefs.

"The reason I used the shirtwaist pieces is obvious," said Harris, "because of the waist factory. And the reason I use the handkerchiefs is because of the loss and the grief."

She calls the pieces prayer flags.

"So many people, they blame your family for what happened," said Miller.

"Yes, I know," said Harris. "And I think that if I had lost my children in a fire, I would've wanted to blame someone as well. I think that's human nature; you want to vilify someone who's hurt you so badly."

So many lives cut short that day. So many families broken. So many memories, lost and found, and so much pain.

But also stories of courage and triumph. And that, says Michael Hirsch, is worth remembering.

"These people didn't set out to be heroes," said Hirsch. "They weren't like soldiers on the battlefield, running up the beach, knowing that you might die. They wanted what we all want. They wanted to have a successful life here. They wanted to be Americans.

"And their sacrifice - that terrible death - is the thing that really motivated people to start thinking about doing things differently in this country. So in a way, they are kind of heroes. I look at it that way."

When Miller asked Harris what she felt was the legacy of the fire, Harris replied, "We need to remember that we as a people who live on this planet need to care for one another, and really respect one another.

"I hope that people will never forget."

Schwarz-graue Rauchschwaden durchziehen sekundenschnell die Straßen im Stadtteil Greenwich Village. Das verzweifelte Kreischen von Frauen in Todesangst lässt vorbeikommende Passanten erstarren. Nur James Meehan schaltet sofort. Der berittene Polizist gibt seinem Pferd die Sporen und galoppiert auf das brennende Backsteinhaus zu. Ohne zu zögern, springt Meehan aus dem Sattel und verschwindet im Eingang des rauchgetränkten Gebäudes.

Es ist 16:40 Uhr als am 25. März 1911 das bis dato tragischste Feuer-Inferno der amerikanischen Industriegeschichte ausbricht. Nur fünf Minuten trennen die rund 600 Näherinnen der Triangle Shirtwaist Company, einer Blusenmanufaktur im Garment District Manhattans, vom offiziellen Produktionsschluss am Samstag. Für die jungen Näherinnen im Alter zwischen 16 und 26 Jahren geht eine lange und anstrengende Sechs-Tage-Woche zu Ende. Durchschnittlich 72 Stunden pro Woche schuften die Schneiderinnen, größtenteils Immigrantinnen aus Russland, Italien und Deutschland, für den damals größten Blusenproduzenten Amerikas. Zum Zeitpunkt des Unglücks erstreckt sich der Produktionsbetrieb der Triangle Shirtwaist Company auf die drei obersten Stockwerke des zehnstöckigen "Asch"-Gebäudes. Der 1901 fertiggestellte Backsteinbau entspricht baulich den Standards damaliger Feuerschutzbestimmungen. Allerdings sind in den Industrie-Lofts der Blusenmanufaktur keine Sprinkleranlagen montiert. Getrieben von purer Gier halten es die Besitzer Blanck und Harris außerdem nicht für notwendig, ihre 600-köpfige Crew mit gelegentlichen Feuerübungen auf einen etwaigen Ernstfall vorzubereiten, obwohl der Produktionsbetrieb bereits in der Vergangenheit immer wieder von kleineren Bränden heimgesucht wurde.

Warum das Feuer an diesem Samstagnachmittag im März 1911 ausbricht, wird sich später nicht mehr gänzlich rekonstruieren lassen. Am wahrscheinlichsten scheint den ermittelnden US-Behörden eine unachtsam weggeschnippte Zigarettenkippe als Brandursache: eine fatale Unachtsamkeit in einer Produktionsstätte, die nicht selten knöchelhoch mit leicht entflammbaren Stoffresten übersät ist. So auch an diesem Tag, der für 146 Arbeiterinnen und Arbeiter mit dem Tod enden soll.

Das Inferno beginnt im Südost-Flügel des achten Stockwerks. Blitzschnell fressen sich die Flammen durch die größtenteils hölzerne Einrichtung. Binnen weniger Sekunden stehen Tausende bereits produzierter Baumwoll-Blusen auf den Werktischen der Näherinnen in Flammen. Panik bricht aus. Die Schneiderinnen versuchen über ein noch zugängliches Treppenhaus, das Gebäude zu verlassen. Ein Buchhalter unterrichtet noch die Kollegen im zehnten Stock per Telefon über das Feuer. Über eine Luke fliehen die dort untergebrachten Arbeiterinnen auf das Gebäudedach, wo sie später von Hilfskräften gerettet werden. Aufgrund einer fehlenden Telefonverbindung zum neunten Stockwerk bleibt eine rettende Warnung für die dort immer noch produzierenden Arbeiterinnen aus.

Rettung per Aufzug

James Meehan kann nichts sehen. Als der Polizist im achten Stock des Produktionsgebäudes ankommt, macht pechschwarzer Qualm eine Orientierung nahezu unmöglich. Meehan ringt nach Luft. Die übermannshohen Flammen saugen den Sauerstoff aus jeder Ritze des Raumes. Die Hitze ist unerträglich. Leblose Frauenkörper versperren den Zugang zum rettenden Aufzug. Manche von ihnen bereits bis zur Unkenntlichkeit verbrannt. Im Treppenhaus trampeln sich die fliehenden Arbeiterinnen gegenseitig zu Tode.

Gemeinsam mit dem Liftboy Joseph Zito, einem Angestellten der Triangle Shirtwaist Company, gelingt es Meehan, einen der beiden Personenaufzüge wieder in Gang zu bringen. Mehr als fünfmal pendeln die beiden Männer mit dem letzten verbleibenden Aufzug zwischen dem achten Stock und der Lobby des Gebäudes. So lange, bis die Mechanik des Aufzugs aufgrund der immer stärker werdenden Hitze des Feuers versagt. Mehr als 130 Arbeiterinnen retteten die beiden Männer in ihrer selbstlosen Aktion aus der Feuerhölle.

Erst als die Flammen durch den Fußboden schlagen, bemerken die jungen Näherinnen im neunten Stockwerk ihre aussichtslose Lage. Zu diesem Zeitpunkt ist das rettende Treppenhaus im Südost-Flügel des Gebäudes bereits aufgrund der drastischen Rauchentwicklung nicht mehr passierbar. Die Tür zu einem zweiten, rettenden Treppenhaus auf der gegenüberliegenden Seite ist von außen verschlossen. Wie sich später herausstellen wird eine Maßnahme der Eigentümer, um Diebstahl vorzubeugen. Ein makaberes Detail der Tragödie, mit dem sich die Staatsanwaltschaft im Nachgang intensiv auseinandersetzt. Nachdem keines der beiden Treppenhäuser mehr als Fluchtweg zur Verfügung steht, bleibt den jungen Frauen noch eine letzte Chance: Eine schmale Feuerleiter, die an der Außenfassade des Gebäudes angebracht ist. Doch schon nach kurzer Zeit bricht das marode Stahlgestell unter der Last der Flüchtenden zusammen und reißt 24 Arbeiterinnen mit sich in die Tiefe.

Sprung in den Tod

Als das erste Feuerwehrauto die Unglücksstelle erreicht, haben die Flammen bereits alle drei Stockwerke ergriffen. Für die Frauen im neunten Stockwerk sind die heraneilenden Rettungskräfte die letzte Hoffnung, dem Inferno doch noch lebend zu entkommen. In Windeseile bringen die "Firefighters" ihre Ausrüstung in Position. Und dann werden die umherstehenden Passanten zu Augenzeugen des Unfassbaren: Die Drehleitern reichen lediglich bis zum sechsten Stockwerk. Obwohl seit der Jahrhundertwende in Manhattan mehr als 800 Neubauten errichtet wurden, die über den sechsten Stock hinausragen, haben die zuständigen Dienststellen ihre Ausrüstungen nicht entsprechend angepasst.

Die Aussichtslosigkeit im neunten Stockwerk der Blusenmanufaktur erreicht mit diesem letzten, vergeblichen Rettungsversuch ihren tragischen Höhepunkt. Hilflos und mit dem sicheren Tod konfrontiert, entscheiden sich viele der jungen Arbeiterinnen für den Sprung in die Tiefe. Viele der Springenden halten sich an den Händen, springen zu Zweit, zu Dritt in die Tiefe. Paralysiert von ihrer Machtlosigkeit versuchen die angerückten Feuerwehrmänner, die herunterfallenden Körper mit Netzen vor dem Aufprall zu bewahren. Erfolglos. Auch die Standards damaliger Sprungnetze sind nicht auf Rettungsaktionen über den sechsten Stock hinaus ausgelegt. Keiner der Springenden überlebt. Rund 18 Minuten nach Ausbruch des Feuers haben die Flammen alle drei Stockwerke gänzlich zerstört.

Geburtsstunde der Arbeitnehmerbewegung

Im April 1911, nachdem bekannt wird, dass die Fluchtwege im neunten Stock des Gebäudes von den Eigentümern vorsätzlich verschlossen wurde leitet die Staatsanwaltschaft ein Verfahren wegen Totschlags gegen die Unternehmenseigner Max Blanck und Isaac Harris ein. Aufgrund ihrer guten Verbindungen in die Stadtpolitik werden die beiden Inhaber am 27. Dezember 1911 von diesen Vorwürfen freigesprochen. Ein darauffolgender Zivilrechtsprozess, initiiert von 23 Familien der Flammenopfer, verurteilt Blanck und Harris 1913 zu Ausgleichszahlungen von 75 Dollar pro Opfer. Grade mal einem Fünftel dessen, was die beiden Geschäftsmänner aus ihrem Versicherungsfond an Personenschäden kassiert hatten.

Schon in den Tagen nach dem Unglück werden einmal mehr Rufe nach einer verbesserten Arbeitssicherheit laut. Zwar gibt es in New York bereits seit 1900 den gewerkschaftlichen Zusammenschluss der International Ladies' Garment Workers' Union, kurz ILGWU, allerdings hat der lose Zusammenschluss der Arbeiterinnen keinen nennenswerten Einfluss auf die Mitsprache in den Produktionsbetrieben. Das sollte sich in den kommenden Jahren fundamental ändern.

Am 30. Juni 1911, nur drei Monate nach dem verheerenden Feuer in Downtown Manhattan, unterzeichnete der damalige Gouverneur John Alden Dix ein Gesetz, das die Gründung der staatlichen Feuerschutzkommission initiierte. Die spätere Arbeitsministerin Frances Perkins übernahm den Gründungsvorsitz der Kommission und kämpfte in den Folgejahren vehement für die Integration und Umsetzung von Arbeitnehmerrechten. Die Anstrengungen Perkins' fanden schließlich 1938 im "Fair Labor Standards Act" ihren krönenden Abschluss. Das unter Präsident Franklin D. Roosevelt verabschiedete Gesetz regelt seither landesweit die Arbeitnehmerrechte in Amerika.

Frances Perkins, Arbeitsministerin von 1933 bis 1945, gehörte zu den Augenzeugen des Feuerinfernos an diesem Samstagnachmittag im März 1911. In einem Interview, Jahre nach ihrem Ausscheiden aus der aktiven Politik, verriet Perkins einem neugierigen Reporter den Ursprung für ihren unermüdlichen Kampf um verbesserte Arbeitnehmerrechte in Amerika: "Die Tragödie, die ich damals mit ansehen musste, ist für immer in meine Seele gebrannt. Diese Bilder erinnern mich jeden Tag daran, warum ich mein Leben dem Kampf gegen unmenschliche Arbeitsbedingungen gewidmet habe."

MyTSA puts the most frequently requested information about security procedures at airport checkpoints right at their fingertips. The application has multiple functions, including allowing travelers to find out if an item can be taken in checked or carry-on bags, view delays at all U.S. airports via a feed from the Federal Aviation Administration (FAA), get some of the most commonly asked packing and traveling tips, and post and see other passengers’ checkpoint wait times at specific airports.

TSA also has the ability to update the application to give users the most up to date information to help them prepare for security. If a specific item is not listed on the ‘Can I Bring?’ tool, users can submit it, through the app, directly to TSA for consideration to be added to the app.

MyTSA has multiple functions, including the following tools:

Airport Status: Users can see what airports are experiencing general delays (not flight specific) or search for conditions at a specific airport. This information is provided by the FAA.
‘Can I Bring?’: Users can type in an item they plan to bring on a trip to find out if it is permitted or prohibited, and whether they can pack it in carry-on or checked bags.

Governor Unveils Two New Drinking Water Initiatives

Gov. Jack Markell announced two new efforts to better inform Delawareans about the quality of their drinking water, continuing a focus on drinking water safety he began last year.
First, the Governor proposed a requirement to test individual private wells for contaminants when wells are first drilled or when homes with private wells are sold. Second, Gov. Markell unveiled comprehensive information on the drinking water quality of every public water system in the state that has been added to the state’s new water quality website.

New information about private well water
The proposal to test private wells is a recommendation from Delaware Health and Social Services and the Department of Natural Resources and Environmental Control, which concluded that more should done to protect and inform users of individual drinking water wells.
DNREC, which regulates well drilling, will propose a regulation requiring a water quality test when new private drinking water wells are drilled, or when a home with a private well is sold.
For the 82 percent of Delawareans who are served by public water systems – from cities and towns to water companies to smaller community systems – we ensure their water is tested regularly for an array of potential contaminants,” Gov. Markell said. “But 146,000 people in our state who rely on their own wells don’t have the same assurance. The private well testing requirement will help ensure that families, when buying a home, will have accurate information on the quality of their well water.”
DNREC will propose a phased approach with some of the requirements becoming effective before others. This requirement will eventually include sampling bacteria and certain chemicals, as well as volatile organic compounds, many of which can be carcinogens. Samples will be analyzed by private labs that are certified by DHSS. The proposed regulation would not affect non-potable private wells, such as those used for irrigation.
Secretary of Health and Social Services Rita Landgraf said the new requirement will put Delaware in step with surrounding states and counties when it comes to protecting the health of those with private wells. Some mortgage companies in Delaware already require private well tests, she said.
Although well water may taste, smell and look fine, the only way to know for sure that water is safe to drink is to test it. By discovering contaminants early, Delaware families on private wells may avoid immediate and possible long-term health risks,” Secretary Landgraf said. “We should give private well owners the same protection that Delawareans drinking public water have.”
Under the proposal, tests that find contaminants would be provided to the homeowner, the prospective purchaser and DNREC, which will use the results to track the overall condition of the state’s water supplies.
“Protecting and improving water quality is among the most important responsibilities of the state,” said DNREC Secretary Collin O’Mara. “This is both a consumer and environmental protection initiative. Whether served by a public system, a public well or private well, Delawareans have a right to know about the quality of their drinking water. The testing will provide DNREC and DHSS with groundwater data that will help our agencies prioritize areas for further investigation and remediation.”
The proposed testing requirements drew support from the Delaware Cancer Consortium.
“It is critical that individual Delawareans make informed decisions when purchasing or building a home. It is also important that we better understand and address potential high-risk areas across the state,’ said Consortium chair Bill Bowser. “I look forward to continuing the work of the Delaware Cancer Consortium with additional data to guide us.”
“Better understanding our exposure to harmful chemicals is the first step in reducing our risk, “ said Meg Maley, chair of the Consortium’s Environment Committee. “I applaud Governor Markell for his continued commitment to making our environment safer and assuring that we have the information we need to lead healthier lives.”
After discussions with stakeholders, DNREC plans to present the specific proposed regulatory changes in workshops in the spring, and then formally accept comments on the change through a public hearing process.

Delaware Drinking Water Watch
Gov. Markell also unveiled new public access to comprehensive information and test results for every public water system in the state.
In September, a new website was launched by DHSS and DNREC - waterquality.delaware.gov – as a compilation of state resources about water, along with a new easy-to-use map with instant access to the annual water quality report for each public water system.
Drinking Water Watch, now listed on the water quality site, dramatically expands the information available about these systems, including detailed testing results, dates of site visits by inspectors, and history of any violations, all updated as tests occur and are reported to DHSS’s Division of Public Health.
“This is very technical information, but for those who really want to know what is in their water, it will all be on view from now on,” Gov. Markell said.\
As an example, Gov. Markell, speaking at the Division of Public Health lab in Smyrna, said the Water Watch site showed the latest test for chemicals in the Town of Smyrna water system was conducted on January 27, 2011, found chlorine, fluoride and nitrates all within normal levels and that the water had a pH of 7.2.
The type of information is available for almost 500 public sources of water in Delaware – not only municipalities, community systems and water companies that supply water to homes and businesses, but also restaurants, convenience stores, schools, daycares and other businesses that are served by an individual well and make water available to significant numbers of customers, employees, visitors or children.

In conjunction with the creation of “America The Story of Us,” HISTORY turned to the Library of Congress’s collections to create a short-form video about the untold story of the Statue of Liberty (officially called “Liberty Enlightening the World”) — one of the most recognizable images associated with America’s story. Do those who suffer mental illness face longer waits in the ER?
This week, a district court judge in New York ruled that under the Americans with Disabilities Act, all eligible mentally ill people living in adult homes should be offered the chance to move out into their own apartments integrated within the community through a process called 'supported living.'

The money residents already receive on disability would go to pay rent, rather than adult home fees, and a team of social workers, psychiatrists and other health professionals would visit them.

Though the decision only affects New York, national mental health experts saw possible national implications because the decision was an interpretation of federal law and other large cities follow models similar to New York's for housing the mentally ill.

The ruling was a 'dream come true' for one resident of 200-bed adult home in Coney Island, Brooklyn. Indeed, many advocates for the mentally ill hailed the move as a way to improve the lives of people who are stuck for decades, regardless of their level of disability, in complexes that operate like unsupervised nursing homes."

Being Ready, in Quake Zones or Snow Zones

Nearly every person on the planet lives in a hazard zone of some sort, with the possibility of a severe storm or shaking ground or bomb or some other disturbance disrupting daily life for many days, if not weeks. Having the capacity, as a household and community, to respond and get by without help for a while is vital. A lot of resilience is afforded through a little planning and investment.

If I’d followed my colleague Tom Zeller’s advice and invested in a wood-stove-style insert for my fireplace — as I’ve muttered about for years — my family wouldn’t have had to sleep in a 45-degree house for four days in the wake of the epic snowstorm in the Northeast last week. (Although we still would have had to melt snow on our propane stove to flush the toilets; watch the video below for more survival tips from the snow zone.)

Preparing for the inconvenience of no heat or tap water for a few days — which can count as a disaster in prosperous countries — is a far cry from preparing for a potent hurricane or devastating inevitable seismic hit. But the benefits of some training and a little equipment are clear at every scale. The team of quake rescue volunteers I wrote about last week in the Bagcilar district of quake-threatened Istanbul has already helped respond to a terrorist bombing, a severe flood and a fire. As the lead organizer there explained to me, citing China’s earthquake as an example:

China has the biggest civil defense capability in the world, but it still took three or four days to reach the collapsed towns. If there is the big one here [or anywhere], you are all alone to cope with whatever you have, at least for the first 72 hours.

Below you can read more useful background on how to prepare for disaster, sent by Ilan Kelman, a senior research fellow at the Center for International Climate and Environmental Research in Oslo. (Another focus of Dr. Kelman’s is how disasters, from quakes to climate disruption, foster –or don’t –cooperation among nations, a topic I touched on as United States Navy ships steamed toward the Haiti quake zone.)

Here’s Dr. Kelman’s note:

[T]here is plenty that everyone can and should be doing: create or join your local citizens disaster response team. For the U.S.A., the Community Emergency Response Teamprogram gives you what you need. There is even a curriculum for secondary schools: Teen SERT.

For more teams, see “Community Sustainability Teams” (a report Dr. Kelman wrote for a very useful consortium, Risk Reduction Education for Disasters. We all have a role to play in helping ourselves deal with disasters.

Creating community disaster teams has other advantages. People learn day-to-day skills such as first aid, can identify and can aim to solve causes of vulnerability in their community (such as tree branches overhanging power lines or garbage clogging drains), can meet their neighbors, and can build trust and community. The youth teams, in particular, have been life-forming events for some of the teenagers, getting them into the voluntary spirit and giving them practical experience that helps them get into university and to get jobs.

Consequently, these teams do not just sit around waiting for a disaster and then leap into action. Instead, weekly meetings, monthly activities or training, and annual exercises all build a sense of community, get participants thinking about sustainability and environmental issues, and teach people important skills for assisting neighbors, communicating with each other, and respecting and understanding similarities and differences. Ultimately, disaster teams improve individuals and communities in the absence of a disaster and then save lives when disasters occur.

Keep in mind that your chances of dying in a car accident far exceed the risks of any of the hazards described above — let alone of terrorism or a pandemic. But do have a look around your daily routine, neighborhood and home, consider risks from both “slow drips” (that flickering light fixture or dripping pipe) and “hard knocks” (your personal disaster exposure) and ponder ways to limit your regrets. That is a person-scale version of the ongoing planet-scale exercise here on Dot Earth.

Traurig war auch die Mutter von Itai Abelski, als der die Heimat verließ. Traurig wie jede Mutter, deren Sohn im Teenager-Alter für eine Zeit in ein anderes Land geht. Doch sie hatten diesen Schritt gemeinsam entschieden, damals, vor vier Jahren, die Eltern und der 16-jährige Junge mit dem schnellen Mundwerk. Er sollte Israel besser kennenlernen, das Land, das sie so oft bereist haben, das Land, in das die jüdische Familie zeitweise auswandern wollte. Itai ging auf ein Internat in Nordisrael. Er genoss das freie Leben, verbrachte den Sommer mit neuen Freunden am Strand, lernte Hebräisch und auch viel über seine Religion. Und eines Tages, als Itai seine Eltern in Düsseldorf besuchte, saß hinter seinem blonden Pony eine Kippa.Als Uli Becker wieder einmal in das Flugzeug nach Israel steigt, ist seine Mutter enttäuscht. Atheistisch hatte sie ihn erzogen, so wie es ihrer sozialistischen Überzeugung entsprach. So etwas wie Gott brauchst du nicht, sagt sie, wenn du nur selber stark genug bist. Doch Uli fliegt. Was er zu diesem Zeitpunkt noch nicht weiß: Es wird ein Abschied für immer sein.

Beide, Uli wie Itai, sind in Deutschland geboren. Als Gäste kamen sie nach Israel und entdeckten, dass dieses Land, und nur dieses Land ihre neue Heimat sein kann. Deshalb studieren sie jetzt hier. Jedes Jahr ergeht es einigen Dutzend deutschen Austauschstudenten ganz ähnlich. Doch der Weg, den Uli und Itai bis zu ihrer Erkenntnis gegangen sind, könnte kaum unterschiedlicher sein

Als Uli zum ersten Mal in Tel Aviv landete, kam er, der religionslose Deutsche, nicht als Sinnsuchender. »Das Einzige, was mich da mit dem Judentum verband, war, dass ich Kafka mochte«, sagt der heute 27-Jährige rückblickend und muss lachen. Nach dem Abitur wollte er seinen Zivildienst im Ausland ableisten, am liebsten in Frankreich. Es gab nur noch Plätze in Israel, Uli dachte nicht lange nach und schrieb sich ein. Es wurde ein tolles Jahr, Uli arbeitete tagsüber mit Behinderten und führte abends lange Gespräche mit israelischen Freunden. Und der junge Rostocker, der nur einmal in seinem Leben eine Kirche betreten hatte, fühlte sich plötzlich zu einer Religion hingezogen, dem Judentum. Zunächst will er sich das nicht eingestehen. Konvertieren sei ein Zeichen von Schwäche, sagte sich Uli, das machen nur Leute, die vor etwas davonlaufen wollen. So bin ich nicht.

Nach dem Gespräch mit einem Rabbi steht für Uli fest: Er will Jude werden

Uli kehrt zurück nach Deutschland, studiert in Berlin Philosophie und Altgriechisch. Er versucht sich zu »reintegrieren«, wie er sagt, doch das gelingt nicht. Uli fühlt sich entwurzelt. Die politischen Diskussionen mit Kommilitonen nerven, er muss Israel immer verteidigen. Seine Professoren nimmt er als eitle Gelehrte wahr, nicht als Persönlichkeiten. Als ihm ein Freund aus Israel eine Thora in deutscher Übersetzung schickt, beginnt Uli zu lesen. Und nach einem Gespräch mit einem Rabbi steht der Entschluss fest: Uli will Jude werden. Er fährt nach Jerusalem, absolviert den Kurs für Konvertiten. Er hat Fächer wie Beten oder Jüdische Geschichte, lernt, was koscher ist und was nicht. Nach zehn Monaten ist er zurück in Berlin und stellt zum zweiten Mal fest, dass er in Deutschland nicht leben kann. Meldet sich bei der Jewish Agency, der Organisation, die sich um die Einwanderung von Juden kümmert und jedes Jahr etwa hundert Bundesbürger in den jüdischen Staat bringt, und verabschiedet sich ein letztes Mal von seiner Mutter.

Bei Itai war der Weg ins neue Leben direkter. Vier Jahre nachdem er als 16-Jähriger mit geringen Hebräischkenntnissen ins Land kam, plaudert er lässig in einem Café in Tel Aviv mit dem Kellner. Aus dem Schüler von damals, der Heimweh hatte und dem nicht klar war, ob er nur ein paar Monate bleiben sollte, ist ein selbstsicherer junger Mann geworden. »Ich war schon immer direkt, hatte Chuzpe«, sagt er. Dieser Satz wird von Itais rheinischem Einschlag unterstrichen, aber auch von der israelischen Art, das Gesagte mit Gesten zu unterstützen. Wenn er mit der Rechten durch die Luft fährt, muss er sich mit der Linken zum Ausgleich am Tisch festhalten.

Schon während der Schulzeit genoss er, dass sich das religiöse Leben in Israel nicht nur in der isolierten Nische der Gemeinde abspielte wie daheim in Düsseldorf. Sondern auf jeder Straße, vor allem natürlich in Jerusalem. Dorthin zog es Itai nach dem Abitur. Anstatt wie geplant nach Deutschland zurückzukehren, schrieb er sich an einer Jeschiwa ein, einer Religionsschule. Doch dann wandte er sich Weltlicherem zu. Itai sagt, er sei nicht so der Typ zum Sitzen, »und das muss man beim Studium der Religionsphilosophie Jahre, kein Witz«.

Heute studiert er am Interdisciplinary Center in Herzliya. Einer kleinen privaten Hochschule, 1994 gegründet, auf dem Campus viele Skulpturen und viel Grün, dazwischen moderne Vorlesungsräume. Nach seinem Bachelor in Betriebswissenschaften will er einen Master machen, vielleicht in den USA. »Ich fühle mich als Teil des Landes, als Teil der Gesellschaft«, sagt Itai. Doch wo das Leben ihn hinziehen wird, weiß er mit seinen 20 Jahren nicht. Deshalb steckt auch noch ein deutscher Pass in seiner Tasche und kein israelischer. Die »Aliyah«, der »Aufstieg«, wie der Prozess der Einbürgerung auf Hebräisch heißt, ist eine ernsthafte Option für ihn, um seine Verbundenheit zu Israel zu demonstrieren. »Dann wäre es endgültig.« Einfach wäre dieser Schritt für Itai nicht: Er ist ein »Düsseldorfer Jung«, der an seiner Heimat hängt. Wenn er von ihr spricht, benutzt er Ausdrücke wie »mein nettes Deutschland«.

Seinen deutschen Pass behielt Uli im Andenken an seine verstorbene Mutter

Auch Uli hat neben dem israelischen noch einen deutschen Pass, und das hat mit seiner Mutter zu tun. Kurz nachdem er Deutschland endgültig in Richtung Israel verlassen hatte, bekam er einen Anruf. Die Mutter war tot, gestorben mit 42 Jahren an einer Herzattacke, als sie mit seinen Brüdern in Schnee spielte. Uli halfen die jüdischen Trauerrituale, die er vollzog, bevor er zur Beerdigung nach Deutschland flog. Doch genauso half ihm, dass er sich kurz vor dem Tod noch mit der Mutter ausgesöhnt hatte. Er erzählte ihr am Telefon von seiner bevorstehenden Verlobung, sie freute sich, hörte ihm zu und verstand am Ende, dass er die Religion gefunden hatte, weil er wie sie ein philosophisches System mit sozialen Werten gesucht hatte. Seine deutsche Staatsbürgerschaft behielt er nun, um den Geist der Mutter ein wenig weiterleben zu lassen.

Jan. 16 is the two-year anniversary of the launch of the Library’s account on Flickr, the photosharing website. We started with approximately 3,100 photos in our account; today 30 additional archives, libraries, and museums from the U.S., Australia, Canada, France, Great Britain, the Netherlands, New Zealand, Norway, Portugal, Scotland, and Sweden now contribute images with no known copyright restrictions to the “Commons” on Flickr.

The Commons loudly invited people to “help describe the world’s public photo collections,” which in turn inspired a spontaneous “Friends group” and website called Indicommons, where supporters write about interesting images, curate thematic selections, set up interactive games, and create new applications.

As of today, there have been more than 23 million views of the images and more than 27,700 Flickr community members call us a contact. In two years, we have loaded more than 8,000 images in two collections (historic photographs and historic newspapers) in 11 sets on diverse topics—baseball, women’s rights, and Abraham Lincoln, to name a few. Over a thousand records in the Prints and Photographs online catalog have been enhanced with information from the Flickr Commons community. More accurate and detailed information in our catalog, with links to interesting histories, makes the pictures not only easier to find but easier to understand. The interactions with our photos are remarkably varied-ranging from the practical (corrected spellings and dates) to the imaginative. Energy for volunteering information continues to run high.

Just in time for the birthday, there’s a new Library of Congress set on Flickr, titled “Great Comments, THANK YOU!” It points to images that generated a variety of interesting comments.

We look forward to the coming year and making more connections!

FDA Alert: New USP Standards for Heparin Products Will Result in Decreased Potency
Adjustments may be needed to achieve desired anticoagulant effect in some patients
New Heparin to Ship Starting October 8

The U.S. Food and Drug Administration today alerted health care professionals to a change in heparin manufacturing that is expected to decrease the potency of the common anti-clotting drug.

To ensure the quality of heparin and to guard against potential contamination, the United States Pharmacopeia (USP), a nonprofit standards-setting organization, adopted new manufacturing controls for heparin. These changes include a modification of the reference standard for the drug’s unit dose.

Manufacturers in the United States label the amount of heparin included in their products based on USP standards. The changes adopted by the USP for the heparin unit dose match the World Health Organization’s International Standard (IS) unit dose definition that has been in use in Europe for many years. The revised USP reference standard and unit definition for heparin is about 10 percent less potent than the former USP unit.

A unit is the measure of a drug’s activity in the body. For heparin, a unit dose is the measure of the drug’s ability to block the blood’s natural clotting ability (anticoagulation). Heparin’s potency is determined by the dose of the drug required to produce a specific level of anticoagulation.
Manufacturers for the U.S. market have begun to make heparin using the new USP standard. While the USP manufacturing controls take effect Oct. 1 for production, the FDA has asked that they not ship this new product to customers until Oct. 8, 2009, or later. The delay will give health care providers and facilities time to learn about the changes and to make adjustments to their pharmacy procedures and dosing practices, according to John Jenkins, M.D. director of the Office of New Drugs in the FDA’s Center for Drug Evaluation and Research.

“Although the FDA-approved labeling for heparin has not changed, including the recommended doses, it is essential that health care professionals be aware of the potential difference in potency between the old and new vials of heparin when administering the drug,” said Jenkins.
Four companies market heparin in the United States. APP, the largest manufacturer, markets heparin in vials; Hospira markets heparin in intravenous bags, vials, and syringes; Baxter markets heparin in intravenous bags, and B. Braun markets heparin in intravenous bags. The FDA has asked that all manufacturers identify their new products to help pharmacies and health care professionals differentiate it from the former product.

Prescription and over–the–counter medicines available in the United States must generally meet USP's public standards, when such standards exist. The revised standards for heparin are contained in a new USP monograph.

The monograph was revised, in part, in response to a 2007- 2008 incident of heparin contamination involving a manufacturing step in China. The contaminated heparin was associated with deaths and other adverse events in the United States. The monograph was changed to include a test for the contaminant.

What Is a “Fiancé(e)”?

A fiancé(e) is a person who is engaged or contracted to be married. The marriage must be legally possible according to laws of the state in the United States where the marriage will take place.

In general, the two people must have met in person within the past two years. The Department of Homeland Security's U.S. Citizenship and Immigration Services (USCIS) grants some exceptions to this requirement. For example, it may be contrary in some traditions for a man and woman to meet before marriage.

Sometimes the USCIS considers a person a "fiancé(e)" even though a marriage contract has been concluded. In such cases, the American citizen petitioner and his/her spouse have not met, and they have not consummated the marriage.

How Does a Fiancé(e) Visa Work?

If you are an American citizen and you want your foreign fiancé(e) to travel to the United States to marry you and live in the U.S., you must file Petition for Alien Fiancé(e) in the United States.

Petition: Filing and Next Steps at NVC and the US Embassy

You must file the Petition for Alien Fiancé(e), Form I-129F, with the Department of Homeland Security's U.S. Citizenship and Immigration Services (USCIS) office that serves the area where you live. See the Department of Homeland Security's USCIS Field Offices for information on where you can file the petition. Note: You cannot file this petition at an embassy, consulate or U.S. immigration office abroad.

After the USCIS approves the petition, it sends the petition to National Visa Center for processing, prior to sending it to the embassy or consulate where your fiancé(e) will apply for a K-1 nonimmigrant visa for a fiancé(e).

What Should I Know about International Marriage Broker Regulation Act (IMBRA)?

Detailed information about the International Marriage Broker Regulation Act (IMBRA) of 2005 petition requirements are shown in the new Form I-129F, Petition for Alien Fiancé(e) instructions.

Extending the Petition

The I-129F petition is valid for four months from the date of approval from USCIS. Consular officers can extend the validity of the petition (revalidate the petition) if it expires.

A Fiancé(e) Is Also an Immigrant

Because a fiancé(e) visa permits the holder to immigrate to the U.S. and marry an American citizen shortly after arrival in the United States, the fiancé(e) must meet some of the requirements of an immigrant visa.

Applying for a Visa

The consular section at the embassy or consulate where you, the fiancé(e) of an American citizen, will apply for a visa, will tell you about any additional specific requirements that you need to fulfill to complete your visa application, such as where you need to go for the required medical examination. During the interview process, an ink-free, digital fingerprint scan will be taken. Some visa applications require further administrative processing, which takes additional time after the visa applicant's interview by a Consular Officer. The following is required:

· A passport valid for travel to the United States and with a validity date at least six months beyond the applicant's intended period of stay in the United States (unless country-specific agreements provide exemptions).

· Birth certificate

· Divorce or death certificate of any previous spouse for both the applicant and the petitioner

· Police certificate from all places lived since age 16

· Medical examination (vaccinations are optional, see below)

· Evidence of financial support (Form I-134, Affidavit of Support may be requested.)

· Two Nonimmigrant Visa Applications, Form DS-156 (A Form DS-156, prepared in duplicate.)

· One Nonimmigrant Fiancé(e) Visa Application, Form DS-156K

· Two nonimmigrant visa photos (each two inches 50 X 50 mm square, showing full face, against a light background)

· Evidence of a fiancé relationship

· Payment of fees, as explained below.

The consular officer may ask for additional information according to the circumstances of the case. Documents in foreign languages should be translated.

Take clear, legible photocopies of civil documents, such as birth and marriage certificates, to the interview. Original documents can then be returned to you.

Should K-1 fiancé(e) visa applicants use the I-864 or the I-134?

Since fiancé(e)s are nonimmigrant visa applicants, they should use the I-134. They will need to submit an I-864 to U.S. Citizenship and Immigration Services (USCIS) when they adjust status to conditional immigrant in the United States after they are married.

Do the same income requirements apply to all immigrant visa applicants even if they use the I-134?

No. The 125 percent minimum income requirement, the most recent year's tax return and other requirements only apply when an I-864 is needed. Applicants using the I-134 will need to show that their sponsor's income is 100 percent of federal poverty guidelines as required under Section 212(a)(4) of the INA.

Fees - How Much Does It Cost?

Fees are charged for the following services:

· Filing an Alien Fiancé(e) Petition, Form I-129F

· Nonimmigrant visa application processing fee

· Medical examination (costs vary from post to post)

· Fingerprinting fees, if required

· Other costs may include translation and photocopying charges, fees for getting the documents required for the visa application (such as passport, police certificates, birth certificates, etc.), and expenses for travel to the embassy or consulate for an interview. Costs vary from country to country and case to case.

· Filing Form I-485 Application to Register Permanent Residence or to Adjust Status

Vaccination Requirements

United States immigration law requires immigrant visa applicants to obtain certain vaccinations prior to the issuance of an immigrant visa. Panel physicians who conduct medical examinations of immigrant visa applicants are required to verify that immigrant visa applicants have met the vaccination requirements. See IV Vaccination Requirements for the list of required vaccinations and additional information.

As a fiancé(e), you are not required to fulfill this requirement at the time of your medical examination for a fiancé(e) visa. However, you may want to do so. These vaccinations are required when you adjust status following your marriage.

What Must Happen After Getting the Fiancé(e) Visa?

After getting the fiancé(e) visa, your fiancé(e) enters the U.S. through a U.S immigration port-of-entry. The U.S. immigration official gives your fiancé(e) instructions on what to do when he/she enters the United States. You must get married within 90 days of your fiancé(e)’s entry into the United States.

After marriage, your spouse must file Form I-485 Application to Register Permanent Residence or to Adjust Status with the USCIS office that serves the area where you live in the United States. You must fill out the Affidavit of Support, Form I-864, with the USCIS for your spouse's application to become a lawful permanent resident (LPR). Can a K-1 Visa Holder Leave the United States?

The K-1 visa allows a fiancé(e) to enter the United States one time only. If you leave the United States after entering on a K-1 visa, you may not re-enter on the same visa. If you want to leave and re-enter the United States, you should apply with Form I-131 Application for Travel Document to the USCIS office that serves the area where you live for advance parole to return to the United States. Can a K-1 Visa Holder Work in the United States?

As a K-1 visa holder you may file Form I-765 Application for Employment Authorization with the USCIS office that serves the area where you live for a work permit (employment authorization document). For more information see How Do I Get a Work Permit (Employment Authorization Document)?

Children Have Derivative Status

The child of a fiancé(e) may receive a derivative K-2 visa from his/her parent’s fiancé(e) petition. You, the American citizen petitioner, must make sure that you name the child in the I-129F petition. After the marriage of the child’s parent and the American citizen, the child will need a separate form I-485 Application to Register Permanent Residence or to Adjust Status. The child may travel with (accompany) the K-1 parent/fiancé(e) or travel later (follow-to-join) within one year from the date of issuance of the K-1 visa to his/her parent. A separate petition is not required if the children accompany or follow the alien fiancé(e) within one year from the date of issuance of the K-1 visa. If it is longer than one year from the date of visa issuance, a separate immigrant visa petition is required.

Remember that in immigration law a child must be unmarried. The stepparent/stepchild relationship must be created before the child reaches the age of 18.

How Long Does It Take?

The length of time varies from case to case according to its circumstances. The time it takes each USCIS office and each consular office to process the case varies. Some cases are delayed because the applicant does not follow instructions carefully or supplies incomplete information. (It is important to give correct addresses and telephone numbers.) Some visa applications require further administrative processing, which takes additional time after the visa applicant's interview by a Consular Officer.

What If the Applicant Is Ineligible for a Visa?

Certain conditions and activities may make an applicant ineligible for a visa. Examples of these ineligibilities are:

· Trafficking in Drugs

· Having HIV/AIDS

· Overstaying a previous visa

· Practicing polygamy

· Advocating the overthrow of the government

· Submitting fraudulent documents

How to Apply for a Social Security Number Card

2011 Diversity Visa Lottery Program Registration

The Department of State announces the opening of the registration period for the DV-2011 Diversity Visa lottery. Entries for the DV-2011 Diversity Visa lottery must be submitted electronically between noon, Eastern Daylight Time (EDT) (GMT-4), Friday, October 2, 2009, and noon, Eastern Standard Time (EST) (GMT-5), Monday, November 30, 2009. Applicants may access the electronic Diversity Visa entry form (E-DV) at www.dvlottery.state.gov during the registration period. Paper entries will not be accepted. Applicants are strongly encouraged not to wait until the last week of the registration period to enter. Heavy demand may result in website delays. No entries will be accepted after noon EST on November 30, 2009.

The congressionally mandated Diversity Immigrant Visa Program is administered on an annual basis by the Department of State and conducted under the terms of Section 203(c) of the Immigration and Nationality Act (INA). Section 131 of the Immigration Act of 1990 (Pub. L. 101-649) amended INA 203 and provides for a class of immigrants known as “diversity immigrants.” Section 203(c) of the INA provides a maximum of 55,000 Diversity Visas (DVs) each fiscal year to be made available to persons from countries with low rates of immigration to the United States.

The annual DV program makes visas available to persons meeting simple, but strict, eligibility requirements. A computer-generated, random lottery drawing chooses selectees for DVs. The visas are distributed among six geographic regions, with a greater number of visas going to regions with lower rates of immigration, and with no visas going to nationals of countries sending more than 50,000 immigrants to the United States over the period of the past five years. Within each region, no single country may receive more than seven percent of the available DVs in any one year.

For DV-2011, natives of the following countries are not eligible to apply because the countries sent a total of more than 50,000 immigrants to the United States in the previous five years:

Telemarketers Must Obtain Prior Written Approval from Consumers Who Want to Receive Such Calls

Beginning September 1, 2009, prerecorded commercial telemarketing calls to consumers – commonly known as robocalls – will be prohibited, unless the telemarketer has obtained permission in writing from consumers who want to receive such calls, the Federal Trade Commission announced today.

“American consumers have made it crystal clear that few things annoy them more than the billions of commercial telemarketing robocalls they receive every year,” said Jon Leibowitz, Chairman of the FTC. “Starting September 1, this bombardment of prerecorded pitches, senseless solicitations, and malicious marketing will be illegal. If consumers think they’re being harassed by robocallers, they need to let us know, and we will go after them.”

The new requirement is part of amendments to the agency’s Telemarketing Sales Rule (TSR) that were announced a year ago. After September 1, sellers and telemarketers who transmit prerecorded messages to consumers who have not agreed in writing to accept such messages will face penalties of up to $16,000 per call.

The rule amendments going into effect on September 1 do not prohibit calls that deliver purely “informational” recorded messages – those that notify recipients, for example, that their flight has been cancelled, an appliance they ordered will be delivered at a certain time, or that their child’s school opening is delayed. Such calls are not covered by the TSR, as long as they do not attempt to interest consumers in the sale of any goods or services. For the same reason, the rule amendments also do not apply to calls concerning collection of debts where the calls do not seek to promote the sale of any goods or services.

In addition, calls not covered by the TSR – including those from politicians, banks, telephone carriers, and most charitable organizations – are not covered by the new prohibition. The new prohibition on prerecorded messages does not apply to certain healthcare messages. The new rule prohibits telemarketing robocalls to consumers whether or not they previously have done business with the seller.

Under a previous rule that took effect on December 1, 2008, telemarketing robocall messages by businesses covered by the TSR must tell consumers how to opt-out of further calls at the start of the message, and provide an automated opt-out mechanism that is voice or keypress-activated. Prerecorded messages left on answering machines must also provide a toll-free number that connects to the automated opt-out mechanism.

After September 1, consumers who receive prerecorded telemarketing calls but have not agreed to get them should file a complaint with the Commission, either on the donotcall.gov Web site or by calling 1-888-382-1222.

Welcome to our new website! As the Executive Director of the Council, I’m very excited to launch this site as we commemorate Women’s Equality Day on August 26. On this day when we remember the bravery and struggles that won women the right to vote, we are very pleased to add this website to share with everyone the work of this Administration to address the issues of concern to women and girls. The mission of the White House Council on Women and Girls is to ensure that every part of the federal government takes into account the needs of women and girls in the policies we draft, the programs we create, the legislation we support. Through this site you will be able to meet the member of the Council and the key staff in each agency who are charged with meeting this charge from the President.

This site also gives you information on the work we have been doing through the Council highlighting the Anniversary of Title IX, working on health reform, and joining the Vice President in the appointment of a White House Advisor to the President on Violence Against Women. We hope that you will come back often for updates as we and each of the members of the Council moves forward with our work. One of our first steps has been for each agency to assess their current resources addressing women and girls, and to begin planning for the future. In Memory of Eunice Kennedy Shriver

The world has lost a great leader in the struggle to improve and enhance the lives of individuals with intellectual and developmental disabilities

I was deeply saddened to hear that Eunice Kennedy Shriver, executive vice president of the Joseph P. Kennedy, Jr. Foundation, founder and honorary chairperson of Special Olympics, sister of President John F. Kennedy and Senator Edward Kennedy, and the driving force behind the establishment of the NICHD, died this morning, August 11, 2009, after suffering a series of strokes.

Mrs. Shriver has long been a champion for and friend of the NICHD. Together with Dr. Robert E. Cooke, her friend and a scientific advisor to President John F. Kennedy, Mrs. Shriver paved the way for the establishment of the NICHD in 1962 to “encourage imaginative research into the complex processes of human development, from conception to old age.” In recognition of her vision and dedication, Congress passed Public Law 110-154 on December 21, 2007, renaming the Institute as the Eunice Kennedy Shriver National Institute of Child Health and Human Development.

On March 3, 2008, I had the pleasure of welcoming Mrs. Shriver, her family, friends, and other special guests to the NIH campus to recognize the Institute’s renaming. During this special event, we also renamed the Institute’s flagship research centers program in Mrs. Shriver’s honor and inducted her into the NICHD Hall of Honor. Throughout the event, it was clear that Mrs. Shriver was truly appreciative for all the efforts of NIH and NICHD staff in trying to improve the lives of others, especially those who need our help the most. She took the time to shake hands with every person in attendance and thanked them for their work.

Even though the day’s events were to honor her accomplishments and vision, Mrs. Shriver never moved her focus away from those she called her “special friends.”

“I want to ask all of you to believe in the value of every person with an intellectual disability,” Mrs. Shriver said in her remarks on March 3, 2008. “I want to ask the scientists here to work to improve their quality of life. I want to ask the political leaders here to finally give them their due as citizens of this great country.”

Mrs. Shriver went on to talk about her belief in possibility, not just for herself and her family, but for all people, of all levels of ability, throughout the world. She championed for it, working so that all people could strive to achieve their own possibilities, to share their own special gifts and talents, and to be valued as an important part of our world.

Mrs. Shriver leaves many legacies—the NICHD, the Special Olympics, the Eunice Kennedy Shriver Intellectual and Developmental Disabilities Research Centers, her children and grandchildren, her family, her friends. But maybe her most important legacy is how she treated others, which she explained:

“There is no joy like the joy of unleashing the human spirit. There is no laughter like the laughter of those who are happy with others. There is no purpose more noble than to build communities of acceptance for all. This is our glory.”

The world has lost a great leader in the struggle to improve and enhance the lives of individuals with intellectual and developmental disabilities. Mrs. Shriver will be deeply missed.

Privatscheidungen vor religiösen Gerichten wie den arabischen Schariagerichten bzw. den Rabbinatsgerichten in Israel. Die Anerkennung erfolgt auf Antrag. Erst wenn diesem durch Bescheid entsprochen worden ist, entfaltet die ausländische Entscheidung auch für den deutschen Rechtsbereich Wirkung.

Sie ist eben so wenig nötig, wenn beide Ehegatten zum Zeitpunkt der Entscheidung ausschließlich dem Staat angehörten, dessen Gericht oder Behörde die Entscheidung getroffen hat.

Wo wird über die Anerkennung entschieden

Zuständig ist die Justizverwaltung (bzw. ein Oberlandesgericht) des Bundeslandes, in dem einer der früheren Ehegatten seinen gewöhnlichen Aufenthalt hat (Adressen finden Sie hier). Hat keiner der früheren Ehegatten seinen Aufenthalt in Deutschland, so beurteilt sich die Zuständigkeit, falls eine neue Ehe geschlossen oder eine Lebenspartnerschaft begründet werden soll, danach, in welchem Bundesland die Eheschließung erfolgen oder die Lebenspartnerschaft begründet werden soll. Sofern keiner der früheren Ehegatten seinen Aufenthalt in Deutschland hat und in Deutschland auch keine neue Ehe geschlossen und keine neue Lebenspartnerschaft begründet werden soll, ist der Antrag an die Senatsverwaltung für Justiz in Berlin, Salzburger Straße 21 – 25, 10825 Berlin, zu richten

Wo kann der Antrag eingereicht werden

Der Antrag kann mit dem dafür vorgesehenen Formular

über ein deutsches Standesamt, z. B. im Zusammenhang mit der Ausstellung eines Ehefähigkeitszeugnisses
(vgl. Anmerkung am Ende),
über eine deutsche Auslandsvertretung oder
direkt bei der für die Anerkennung zuständigen Stelle

eingereicht werden.

Welche Unterlagen werden verlangt?

Bei Antragstellung soll das vorgesehene Formular verwandt werden, das bei allen genannten Stellen regelmäßig erhältlich ist. Sie können es auch von dieser Seite (Link am Ende unten) herunterladen, am PC ausfüllen und ausdrucken (eine Übersendung per E-Mail ist noch nicht möglich). Dem vollständig ausgefüllten Formular sind folgende Unterlagen beizufügen:

Vollständige Ausfertigung oder beglaubigte Ablichtung der ausländischen Entscheidung mit Rechtskraftvermerk (soweit dieser erteilt wird) und möglichst mit Tatbestand und Entscheidungsgründen
Nachweis über die Registereintragung bei Ländern, in denen diese zur Wirksamkeit der Entscheidung erforderlich ist
Grundsätzlich die Heiratsurkunde der aufgelösten Ehe
Nachweis der Staatsangehörigkeit (z. B. durch beglaubigte Passkopien der geschiedenen Ehegatten)
Von einem anerkannten Übersetzer angefertigte Übersetzungen sämtlicher fremdsprachiger Schriftstücke; lediglich der Übersetzung englischsprachiger Unterlagen bedarf es grundsätzlich nicht
Bescheinigung über den Verdienst/das Einkommen des Antragstellers
Schriftliche Vollmacht, falls der Antrag durch einen Bevollmächtigten gestellt wird

Welche Gebühren werden erhoben?

Das Anerkennungsverfahren ist gebührenpflichtig. Die Gebühr beträgt mindestens 10 Euro und höchstens 310 Euro. Ihre Höhe hängt von den Umständen des einzelnen Falles ab. Bei der Festsetzung der Gebühr sind insbesondere die Bedeutung der Angelegenheit für die Beteiligten, der Verwaltungsaufwand und die wirtschaftlichen Verhältnisse des Antragstellers zu berücksichtigen. Dabei finden auch Unterhaltsverpflichtungen Beachtung. Die übliche Mittelgebühr liegt bei 160 Euro.

Wie lange dauert es bis zur Entscheidung?

Die Bearbeitungsdauer hängt wesentlich davon ab, ob alle für die Prüfung des Antrages erforderlichen Angaben gemacht und die notwendigen Unterlagen vollständig eingereicht werden. Erst dann kann die abschließende Prüfung erfolgen und die Entscheidung ergehen. Verzögerungen können sich im Einzelfall aufgrund der Übermittlungswege und im Zahlungsverkehr ergeben. Deshalb muss in der Regel mit einer Bearbeitungszeit von bis zu zwei Monaten gerechnet werden. Der Standesbeamte ist dann gehalten, den Antrag aufzunehmen und an die zuständige Landesjustizverwaltung oder das zuständige Oberlandesgericht weiterzuleiten, wenn die ihm obliegende Prüfung ergibt, dass die ausländische Entscheidung der Anerkennung bedarf.

Wehrpflicht von Deutschen im Ausland

A. Wehrpflicht

1. Grundsätzlich sind nach dem Wehrpflichtgesetz alle Männer vom vollendeten 18. Lebensjahr an wehrpflichtig, die Deutsche im Sinne des Grundgesetzes sind und ihren ständigen Aufenthalt im Geltungsbereich des Wehrpflichtgesetzes haben oder zuletzt gehabt haben oder einen Pass (eine Staatsangehörigkeitsurkunde) der Bundesrepublik Deutschland besitzen oder sich auf andere Weise ihrem Schutz unterstellt haben (§ 1 Abs. 1).

2. Die Wehrpflicht ruht bei Deutschen, die "ihren ständigen Aufenthalt und ihre Lebensgrundlage ausserhalb Deutschlands haben, wenn Tatsachen die Annahme rechtfertigen, dass sie beabsichtigen, ihren ständigen Aufenthalt im Ausland beizubehalten" (§ 1 Abs. 2). Jemand begründet seinen ständigen Aufenthalt im Sinne des Wehrpflichtgesetzes dort, wo er sich mit dem Willen niederlässt, auf die Dauer zu bleiben und den Schwerpunkt seiner Lebensverhältnisse zu bilden. Wer wirtschaftlich von natürlichen oder juristischen Personen in der Bundesrepublik Deutschland abhängig ist und dort weiterhin persönliche Bindungen unterhält - bei in Ausbildung befindlichen jungen Männern ist auf die Eltern abzustellen - hat seine Lebensgrundlage nicht im Ausland.

Auslandsdeutsche begründen regelmässig noch keinen ständigen Aufenthalt im Inland, wenn sie sich hier nur zum Studium oder zur Ausbildung aufhalten.

Bei Wehrpflichtigen, die sich erkennbar nur vorübergehend im Ausland aufhalten, ruht die Wehrpflicht nicht, sie können zum Wehrdienst herangezogen werden.

Bei Wehrpflichtigen, die ihren ständigen Aufenthalt im Ausland, ihre Lebensgrundlage jedoch im Inland haben, wie entsandte Beamte, Entwicklungshelfer, Firmenvertreter, ruht die Wehrpflicht grundsätzlich nicht. § 43 Abs. 1 macht die Heranziehung dieses Personenkreises vom Erlass eines besonderen Gesetzes abhängig. Dieses wurdes bisher nicht erlassen.

Hiervon gilt eine Ausnahme für diejenigen, die sich tatsächlich im Inland aufhalten, z.B. zur Ausbildung. Sie können gemäss § 43 Abs. 1 S.3 Wehrpflichtgesetz zum Wehrdienst herangezogen werden.
3. Wehrpflichtige haben nach Beginn der Erfassung ihres Geburtsjahrgangs eine Genehmigung des zuständigen Kreiswehrersatzamtes einzuholen, wenn sie das Bundesgebiet länger als drei Monate verlassen wollen (§ 3 Abs. 2).

Zuwiderhandlungen werden als Ordnungswidrigkeit geahndet und stellen nach dem am 01.01.1988 in Kraft getretenen Passgesetz einen Passversagungsgrund dar. Wird der ständige Aufenthalt ohne die nach § 3 As. 2 erforderliche Genehmigung ins Ausland verlegt, ruht die Wehrpflicht nicht (§ 1 Abs. 2 Nr.2).

Von der Genehmigungspflicht ausgenommen sind Wehrpflichtige, deren Erfassung, Musterung, Einberufung und Wehrüberwachung sich gemäss § 43 Abs. 1 WPflG nicht nach dem Wehrpflichtgesetz bestimmen, die also ihren ständigen Aufenthalt ausserhalb des Geltungsbereichs dieses Gesetzes haben, ohne dass ihre Wehrpflicht gemäss § 1 Abs. 2 ruht.

Auslandsdeutsche können also, wenn sie sich etwa zur Berufsausbildung im Inland aufgehalten haben, ohne Genehmigung wieder ausreisen.

Anfragen zur Wehrpflicht können im Einzelfall beim Bundesamt für Wehrverwaltung und bei den Kreiswehrersatzämtern erfolgen.

B. Wehrdienst in fremden Streitkräften

Wer freiwillig in fremde Streitkräfte eintreten will, bedarf der Zustimmung des Bundesministeriums der Verteidigung. Die Zustimmung zum Eintritt wird in der Regel nur Deutschen und deutschen Mehrstaatern erteilt, die sich ständig im Ausland aufhalten oder dorthin auswandern wollen. Ein aufgrund gesetzlicher Vorschrift des Aufenthaltsstaates zu leistender Wehrdienst bedarf keiner Zustimmung.

Das Bundesministerium der Verteidigung kann im Einzelfall Wehrdienst in fremden Streitkräften ganz oder teilweise auf den deutschen Wehrdienst anrechnen. Die Anrechnung soll erfolgen, wenn der Wehrdienst aufgrund gesetzlicher Vorschrift geleistet worden ist oder das Bundesministerium der Verteidigung ihm zugestimmt hat. Die Entscheidung über Zustimmung und Anrechnung hat das Bundesministerium der Verteidigung dem Bundesamt für Wehrverwaltung übertragen.

ran an die Wahlurnen, liebe Mit-Deutsche im Ausland - diesmal koennen wirklich alle Auslandsdeutschen, die nach dem 23. Mai 1949 gerade mal DREI Monate in der Bundesrepublik Deutschland gelebt haben, rechtlich die Deutsche Staatsbuergerschaft besitzen und ueber 18 Jahre alt sind, an der kommenden Bundestagswahl am 27 September 2009 teilnehmen!!! fuellt den Antrag (auf Waehlerregistrierung) aus, dabei bitte beachten, Umlaute als solche zu schreiben (hier drunter ist ein Post fuer Deutsche Umlaute zu generieren), ausdrucken, unterschreiben und ab damit in die gelbe Post!

1. allgemeine Hinweise:

Deutsche im Ausland können unter folgenden Voraussetzungen an der Wahl zum 17. Deutschen Bundestag am 27. September 2009 teilnehmen:

Deutsche, die außerhalb der Bundesrepublik Deutschland leben und hier nicht gemeldet sind, können an der Bundestagswahl teilnehmen, wenn sie
- Deutsche im Sinne des Artikels 116 des Grundgesetzes sind,
- bis zum Wahltag das achtzehnte Lebensjahr vollendet haben,
- nach dem 23. Mai 1949 mindestens drei Monate ununterbrochen in der Bundesrepublik Deutschland gewohnt haben und
- nicht vom Wahlrecht ausgeschlossen sind.

Der noch bei der letzten Bundestags- bzw. Europawahl geltende Ausschluss vom Wahlrecht von außerhalb der Mitgliedstaaten des Europarats lebenden Deutschen, seit deren Fortzug mehr als 25 Jahre verstrichen waren, wurde mit dem Gesetz zur Änderung des Wahl- und Abgeordnetenrechts vom 17. März 2008 (BGBl. I S. 394) gestrichen.

Deutsche, die im Ausland leben und die o.a. genannten Voraussetzungen erfüllen, müssen sich rechtzeitig in das Wählerverzeichnis ihrer letzten Heimatgemeinde in Deutschland eintragen lassen. Diese Eintragung muss schriftlich mit einem besonderen Formular beantragt werden. Zugleich müssen Deutsche an Eides statt versichern, dass sie wahlberechtigt sind.
Die Antragsformulare für die Eintragung in ein Wählerverzeichnis zur Bundestagswahl
- stehen Ihnen auf dieser Seite als Download (PDF-Datei) zur Verfügung (s.u.) oder
- sind im Frühjahr 2009 als Papiervordrucke
  - bei allen Botschaften und Konsulaten des Bundesrepublik Deutschland im Ausland,
  - beim Bundeswahlleiter oder
  - bei allen Kreiswahlleitern in Deutschland erhältlich.

Antragsformulare können dort zugleich für Familienangehörige, Freunde oder Kolleginnen und Kollegen angefordert werden. Firmen und Verbände können sich für ihre Mitarbeiterinnen und Mitarbeiter im Ausland die Antragsformulare in der erforderlichen Stückzahl zusenden lassen.

Die im Ausland lebenden Deutschen müssen jeweils persönlich mit eigenem Antragsformular die Eintragung in das Wählerverzeichnis beantragen und den Antrag mit ihrer eidesstattlichen Versicherung wahlberechtigt zu sein, an die Gemeinde, in der sie vor dem Fortzug aus der Bundesrepublik Deutschland zuletzt gemeldet waren, senden.
Die Anträge müssen auf dem Formular spätestens am 21. Tag vor dem Wahltag, d.h. spätestens am 6. September 2009, bei der zuständigen Stelle in Deutschland eingehen. Die ausgefüllten Antragsvordrucke sollten deshalb möglichst frühzeitig zurückgeschickt werden.
Wahlberechtigte Deutsche im Ausland erhalten nach ihrer Eintragung in das Wählerverzeichnis ohne weitere Anforderung – ca. einen Monat vor dem Wahltag – die für die Briefwahl erforderlichen Wahlunterlagen (Wahlschein, Stimmzettel, Stimmzettelumschlag, Wahlbriefumschlag und Merkblatt zur Briefwahl) übersandt.
Die Wähler müssen dann in dem verschlossenen amtlichen Wahlbriefumschlag
- den Wahlschein nebst eidesstattlicher Versicherung sowie
- in dem verschlossenen amtlichen Stimmzettelumschlag den Stimmzettel der Stelle, die auf dem Wahlbriefumschlag steht, so rechtzeitig übersenden, dass der Wahlbrief dort spätestens am Wahltag bis 18.00 Uhr eingeht.

Deutsche im Ausland, die an der Wahl zum Deutschen Bundestag 2009 in Deutschland teilnehmen wollen, sollten wegen der Besonderheit des Verfahrens und der unter Umständen langen Postwege rechtzeitig handeln. Die deutschen Auslandsvertretungen weisen durch Anzeigen in der ausländischen Presse auf die Wahlmöglichkeit für Deutsche aus dem Ausland hin. Zum Teil bieten die Botschaften und Konsulate auch an, die Beförderung der ausgefüllten Wahlunterlagen für die Briefwahl zu übernehmen. Bitte erkundigen Sie sich hierfür direkt bei der zuständigen Auslandsvertretung. Daneben sollten Familienangehörige oder Freunde, die in der Bundesrepublik Deutschland leben, und Firmen, die Mitarbeiter ins Ausland entsandt haben, ihre im Ausland lebenden Angehörigen, Freunde und Mitarbeiterinnen und Mitarbeiter auf die Möglichkeit und Formalien zur Teilnahme an der Wahl zum 17. Deutschen Bundestag aufmerksam machen.

2. Wichtiger Hinweis für weiterhin in Deutschland gemeldete Personen

Deutsche, die während ihres Aufenthalts im Ausland weiterhin in Deutschland gemeldet sind, werden von Amts wegen in das Wählerverzeichnis ihrer Gemeinde eingetragen. Wahlberechtigte, die in ein Wählerverzeichnis eingetragen sind, können ihr Wahlrecht durch Briefwahl ausüben. Für die Wahrnehmung der Briefwahl muss bei der Gemeindebehörde schriftlich oder mündlich die Erteilung eines Wahlscheines beantragt werden. Die Schriftform gilt auch durch Telegramm, Fernschreiben, Telefax, E-Mail oder durch sonstige dokumentierbare elektronische Übermittlung als gewahrt. Eine fernmündliche Antragstellung ist unzulässig.

3. Wichtiger Hinweis für Rückkehrer

Bei Rückkehr in die Bundesrepublik Deutschland entfällt die sogenannte Dreimonatsfrist, nach der nur wahlberechtigt ist, wer am Wahltag seit mindestens drei Monaten in der Bundesrepublik gewohnt oder sich sonst gewöhnlich aufgehalten hat. Außerdem gilt:

Wer nach Deutschland zurückkehrt und sich hier vor dem 35. Tag vor der Wahl (dem 23. August 2009) für eine Wohnung anmeldet, darf den Antrag für Auslandsdeutsche nicht stellen, weil er von Amts wegen am Zuzugsort in das Wählerverzeichnis eingetragen wird.
Wer sich vor dem 21. Tag vor der Wahl (dem 6. September 2009) anmelden wird, braucht diesen Antrag nicht mehr zu stellen. Auf Wunsch - etwa bei der Anmeldung - wird er in das Wählerverzeichnis seines Zuzugsortes in Deutschland eingetragen. Wenn bereits ein Antrag auf Eintragung in ein Wählerverzeichnis als Auslandsdeutscher gestellt wurde, muss das Wahlrecht an dem Ort ausgeübt werden, wo der Antragsteller in das Wählerverzeichnis eingetragen worden ist.
Wer sich erst nach dem 21. Tag vor der Wahl (dem 6. September 2009) in Deutschland anmelden wird, muss den Antrag auf Eintragung in das Wählerverzeichnis als Auslandsdeutscher stellen, weil er sonst nicht mehr in ein Wählerverzeichnis eingetragen wird.

4. Antrag für Auslandsdeutsche mit Ausfüllhinweisen

Das Antragsformular besteht aus

Erstausfertigung (von Ihnen auszufüllen)
Rückseite der Erstausfertigung (von der Gemeindebehörde auszufüllen)
Zweitausfertigung (wird automatisch wie die Erstausfertigung ausgefüllt)
Rückseite der Zweitausfertigung (von der Gemeindebehörde auszufüllen).

Bitte füllen Sie nur die erste Seite der Erstausfertigung des Antrages unter Beachtung des Merkblattes zu dem Antrag auf Eintragung in das Wählerverzeichnis und zu der Versicherung an Eides statt bis auf die Unterschrift vollständig aus. Ihre Angaben in der Erstausfertigung werden automatisch in die Zweitausfertigung übernommen. Die Rückseite der Erst- und Zweitausfertigung werden nach Eingang Ihres Antrages von der Gemeindebehörde ausgefüllt.

Soweit das für die Beantwortung jeweils vorgesehene Feld ausnahmsweise nicht ausreichen sollte, wird gebeten, nach Ausdruck des Vordruckes gleichlautende handschriftliche Ergänzungen auf dem Papierausdruck der Erst- und Zweitausfertigung (bitte in Druckbuchstaben) vorzunehmen.

Soweit Sie gebeten werden, das Zutreffende anzuklicken (z.B. unter Nr. 6 bei  Personalausweis  Reisepass), kann das Ankreuzen entweder per „Mausklick“ oder mit der „Entertaste“ erfolgen.

Bitte achten Sie darauf, dass die Schreibweise Ihres Namens im Antrag der Eintragung in Ihrem Personalausweis entspricht (z.B. bei den Buchstaben ß oder ss, ü oder ue).

Deutscher Personalausweis im Umbruch

ein abgelaufener Personalausweis ist abgelaufen (und nicht wie ein Pass noch bis zu 1 Jahr theoretisch gueltig), da es in Deutschland Ausweispflicht gibt. Theoretisch kann ein abgelaufener Perso als Ordnungswidrigkeit angesehen werden!!! (das alles steht im Personalausweisgesetz)

momentan ist es nur in 7 von 16 Bundeslaendern in Deutschland moeglich als nicht mit Wohnsitz gemeldeter Auslands-Deutscher einen Personalausweis zu beantragen.

Da aber das gesamte Ausweis-Verfahren mit Wirkung vom 01.11.2010 auf den Bund uebergeht und somit die Laender ab diesem Zeitpunkt aussen vor sind, gibt es erhebliche Neuerungen auf diesem Gebiet, die hier im Folgenden zu lesen sind:

Kabinett beschließt neuen Personalausweis mit Internetfunktion

Das Bundeskabinett hat heute dem Entwurf des Gesetzes über Personalausweise und den elektronischen Identitätsnachweis sowie zur Änderung weiterer Vorschriften zugestimmt.

Damit ist der Weg frei für die Einführung des elektronischen Personalausweises im Scheckkartenformat, der ab November 2010 den bisherigen Personalausweis ablösen wird.

Bundesinnenminister Dr. Schäuble erklärte dazu:

"Der neue Personalausweis macht den elektronischen Geschäftsverkehr sicherer und einfacher für Bürgerinnen und Bürger, Wirtschaft und Verwaltung. Er trägt zum Bürokratieabbau bei und bringt ein enormes Einsparpotential mit sich. Die Zeit, in der elektronische Formulare zwar am PC ausgefüllt, aber am Ende doch manuell unterschrieben und versandt werden mussten, gehört bald der Vergangenheit an. Der elektronische Ausweis spart damit allen Beteiligten Papier, Druck-, Porto-, Transportkosten und vor allem Zeit."

Allein für den Bereich der Kontoeröffnungen werden zukünftig Einsparungen von jährlich rund 130 Millionen Euro möglich, weil der Identitätsnachweis nun im Internet besonders zuverlässig und schnell erfolgen kann. In zahlreichen vergleichbaren Massenverfahren, die einen Identitätsnachweis erfordern, wird mit dem neuen Ausweis die Umstellung auf sichere und effiziente Prozesse möglich.

Über 60 Millionen Bundesbürgerinnen und Bundesbürger nutzen heute ihren Personalausweis nicht nur zum Identitätsnachweis gegenüber Behörden, sondern auch in vielen privaten Situationen.

Und obwohl sich immer mehr Lebensbereiche in das Internet verlagern, gibt es einen vergleichbaren Standard-Identitätsnachweis für die Online-Welt bislang nicht: Bei jedem Diensteanbieter müssen eigene Anmeldeverfahren durchlaufen und separate Passwörter oder PINs angelegt und gemerkt werden. Die damit verbundenen Sicherheitsrisiken und Datenschutzdefizite soll der elektronische Personalausweis beheben und gleichzeitig ein für beide Seiten – Anbieter sowie Nutzer von Online-Services – transparentes Verfahren ermöglichen.

Zukünftig wird ein Anbieter, der den Personalausweis als vertrauenswürdige Infrastruktur in seine Dienste einbinden will, vorher bei einer staatlichen Stelle ein Berechtigungszertifikat beantragen müssen. Nur mit diesem Zertifikat darf er personenbezogene Daten (Name, Anschrift, Alter) aus dem Ausweis-Chip online erfragen. Für den Ausweisinhaber wird diese Berechtigung am Bildschirm sichtbar. Er kann dann seinen Ausweis auf ein Lesegerät am PC legen, seine Ausweis-PIN eingeben und somit der Übermittlung seiner Daten im Internet zustimmen. Dank des gegenseitigen Identitätsnachweises können also beide Partner einer Online-Transaktion der Identität ihres Gegenübers sicher sein.

Dieser elektronische Identitätsnachweis (eID) wird serienmäßig auf jedem Personalausweis vorbereitet sein. Bundesbürgerinnen und -bürger können ab dem Einführungsstichtag 1. November 2010 die Ausweise neuen Typs (auch vor Ablauf ihres bisherigen Personalausweises) beantragen und dann entscheiden, ob die eID-Funktion eingeschaltet wird. Zusätzlich kann eine elektronische Signatur nachgeladen werden. Für E-Government und E-Business eröffnet sich damit eine breite Palette von Anwendungsmöglichkeiten. Das virtuelle Rathaus beispielsweise wird weitere Online-Dienste anbieten können. Auch Online-Shopping, Online-Banking und Querschnittsthemen wie Jugendschutz und Suchtprävention im Internet sowie der Altersnachweis an Automaten werden von den neuen Ausweisfunktionen profitieren.

Auch die elektronische Unterstützung der Reisefunktion des neuen Personalausweises ist vorgesehen: Der Ausweis wird weiterhin als Passersatzdokument nutzbar sein und die Reise in ausgewählte Länder sowie grundsätzlich die Rückkehr in den Schengenraum erlauben. Dafür wird der Ausweis dem sicherheitstechnischen Niveau der EU-weit vorgeschriebenen elektronischen Reisepässe (ePässe) angeglichen und entsprechend den internationalen Vorgaben obligatorisch mit einem Foto im Chip ausgestattet. Ob zusätzlich zwei Fingerabdrücke im Ausweis gespeichert werden, können die Bürgerinnen und Bürger dagegen selbst entscheiden. Wer seine Fingerabdrücke – analog zum ePass – auch im Personalausweis speichern lässt, geht sicher, dass niemand mit seinem gestohlenen Dokument missbräuchlich reisen kann, nur weil er dem Foto ähnlich sieht. Wie bei den bereits eingeführten Reisepässen wird durch gesetzliche und technische Maßnahmen sichergestellt, dass nur berechtigte behördliche Stellen die biometrischen Daten aus dem Ausweis-Chip auslesen können. Für den oben beschriebenen Identitätsnachweis im E-Government und E-Business können Foto und Fingerabdrücke hingegen keinesfalls verwendet werden.

Personalausweis mit Internetfunktion

Ab November 2010 wird der neue elektronische Personalausweis im Scheckkartenformat kommen. Das Dokument erleichtert das Reisen genauso wie Geschäfte und Behördengänge im Internet. Der Gesetzentwurf der Bundesregierung wurde vom Bundesrat gebilligt.

Der neue elektronische Personalausweis ist kleiner, handlicher und macht das Leben leichter: Spezielle neue Funktionen sollen ihn zum sicheren Reisedokument machen und auf Wunsch auch zum "Ausweis für das Internet".

Vielseitig im Internet

Zur Grundausstattung des Dokuments gehört ein elektronisch gespeichertes, biometrisches Bild und ein Chip. Dieser trägt einen vorbereiteten elektronischen Identitätsnachweis.

Bürgerinnen und Bürger können künftig beim Abholen ihres neuen Ausweises entscheiden, ob sie diese Internetfunktion nutzen wollen oder lieber ausschalten lassen. Wird die Internetfunktion gewünscht, kann der Nutzer seine Identität elektronisch nachweisen, zum Beispiel an Automaten oder im Internet.

Der Ausweis kann also Passwörter und Zugangscodes ersetzen und Behördengänge oder die Steuererklärung erleichtern. Das gilt auch für elektronische Geschäfte wie Online-Shopping oder -Banking. Jugendschutz und Suchtprävention können profitieren, zum Beispiel beim Altersnachweis an Automaten.

Sicher unterwegs

So wie bereits der Reisepass soll künftig auch der Personalausweis ein biometrisches Foto tragen. Zudem soll die freiwillige Speicherung zweier Fingerabdrücke möglich sein. Wer diese in seinem Ausweis sichern lässt, kann damit vermeiden, dass Dritte, die ihm ähneln, mit dem gestohlenen Dokument verreisen.

Gegen höhere Gebühren kann auf dem Ausweis auch ein drittes Merkmal installiert werden: die "qualifizierte elektronische Signatur". Dadurch ist der Ausweis künftig auch bei Verfahren einsetzbar, die diesen besonders sicheren Identitätsnachweis voraussetzen.

Ab 1. November 2010 können Bürgerinnen und Bürger den elektronischen Personalausweis erhalten. Sie können den neuen Ausweis auch dann beantragen, wenn ihr aktueller noch nicht abgelaufen ist. Die neue Karte ist nur noch etwa halb so groß wie das heutige blaugrün laminierte Identitätspapier.

Mit Wirkung vom 01.01.2013 koennen dann auch alle Ausland-Deutschen bei ihrer Botschaft nicht nur den Reisepass sondern auch den Personalausweis beantragen.

Ersichtlich das Ganze in einem neuen Gesetz das Bundestag und Bundesrat verabschiedet haben:

Nach Beschlussfassung in den Ausschüssen hat der Bundestag am 18. Dezember 2008 den vom Bundeskabinett am 23. Juli 2008 beschlossenen Entwurf des Gesetzes über Personalausweise und den elektronischen Identitätsnachweis sowie zur Änderung weiterer Vorschriften in dritter Lesung beraten und an den Bundesrat überwiesen. Damit ist der Weg frei für die Einführung des elektronischen Personalausweises im Scheckkartenformat, der ab November 2010 den bisherigen Personalausweis ablösen wird. Die Daten, die heute optisch vom Dokument ablesbar sind, sollen zukünftig in einem Ausweis-Chip gespeichert werden. Damit wird es möglich sein, sich im Internet elektronisch auszuweisen – sowohl gegenüber Behörden im E-Government als auch gegenüber privatwirtschaftlichen Dienstleistungsanbietern im Internet, beispielsweise bei Online-Shopping, Online-Banking oder Online-Auktionen. Gleichzeitig kann der Ausweisinhaber sicher sein, dass diejenige Stelle, die seine Daten abfragt, tatsächlich dazu berechtigt ist. Für behördliche Kontrollen an Grenzen und im Inland – und nur für diese – ist darüber hinaus zur Identitätsfeststellung eine Biometriefunktion vorgesehen: Das digitale Foto wird in allen Personalausweisen enthalten sein. Zwei Fingerabdrücke können auf freiwilliger Basis ebenfalls im Chip gespeichert werden.

Mit dem Entwurf des Gesetzes über Personalausweise und den elektronischen Identitätsnachweis sowie zur Änderung weiterer Vorschriften des Gesetzes soll ein elektronischern Personalausweises im Scheckkartenformat ab November 2010 den bisherigen Personalausweis ablösen. Die neue Dokumentengeneration wird die herkömmlichen Anwendungen des Ausweises um elektronische Funktionen ergänzen:

Ausweis im Internet:

Die Daten, die heute optisch vom Dokument ablesbar sind, sollen zukünftig in einem Ausweis-Chip gespeichert werden. Damit wird es möglich sein, sich im Internet elektronisch auszuweisen – sowohl gegenüber Behörden im E-Government als auch gegenüber privatwirtschaftlichen Dienstleistungsanbietern, beispielsweise bei Online-Shopping, Online-Banking oder Online-Auktionen. Gleichzeitig kann der Ausweisinhaber sicher sein, dass diejenige Stelle, die seine Daten abfragt, tatsächlich dazu berechtigt ist. Auf diese Weise können Prozesse wie Log-in, Eröffnung von Konten und Accounts, Adressverifikation und Altersnachweis sicherer, wirtschaftlicher und schneller realisiert werden. Aufgrund seines Sicherheitskonzeptes hilft der elektronische Personalausweis, Internetkriminalität zu bekämpfen und das Vertrauen der Bevölkerung in elektronische Transaktionen zu steigern. Er stärkt den Schutz vor Identitätsdiebstahl und bietet neue benutzerfreundliche Möglichkeiten für die Umsetzung des Jugendschutzes, letzteres unter anderem an Automaten, beispielsweise beim Zigarettenkauf.

Elektronische Signatur:

Auf Wunsch des Ausweisinhabers kann die qualifizierte elektronische Signatur für E-Government- und E-Business-Anwendungen auf den Ausweis geladen werden.

Sicheres Reisedokument:

Damit der Personalausweis auch in Zukunft als sicheres Reisedokument eingesetzt werden kann, wird die Ausweiskarte ähnlich dem elektronischen Reisepass biometrische Merkmale im Chip erhalten, die für behördliche Kontrollen an Grenzen und im Inland – und nur für diese – zur Identitätsfeststellung verwendet werden können. Das digitale Foto wird zu diesem Zweck in allen Personalausweisen enthalten sein. Zwei Fingerabdrücke können auf freiwilliger Basis ebenfalls im Chip gespeichert werden. Beide Merkmale ermöglichen eine effiziente und sichere Unterstützung der Personenkontrolle, insbesondere zur Bekämpfung der so genannten Look-Alike-Täuschung, d.h. Betrugsversuchen, bei denen verlorene oder gestohlene Dokumente gezielt durch fremde Personen verwendet werden, die dem Inhaber ähnlich sehen oder ihr Erscheinungsbild – etwa durch Änderungen der Frisur, Barttracht, Brille/ Kontaktlinsen – ähnlich gestalten.

Verfahrensstand:

Das Grobkonzept zum elektronischen Personalausweis wurde 2008 veröffentlicht und in Zusammenarbeit mit BITKOM und Deutschland sicher im Netz e.V. im Rahmen von gemeinsamen Workshops und Informationsveranstaltungen mit Vertretern der Wirtschaft, der Wissenschaft, des Datenschutzes und der Verbraucherverbände diskutiert.

Der Entwurf des Gesetzes über Personalausweise und den elektronischen Identitätsnachweis sowie zur Änderung weiterer Vorschriften wurde am 23.07.2008 vom Kabinett beschlossen und befindet sich im parlamentarischen Verfahren.

Fertigstellung der technischen Spezifikationen durch das Bundesamt für Sicherheit in der Informationstechnik
Vorbereitung und Durchführung eines Anwendungstests (Start 2. Halbjahr 2009) mit Partnern aus dem E-Government und E-Business sowie eines Feldtests mit ausgewählten kommunalen Ausweisbehörden
Fortführen der aktiven Mitarbeit in nationalen und internationalen Arbeitsgruppen bzw. Gremien wie dem Deutschen Industrieforum (DIF), dem Europäischen Komitee für Nor-mung (CEN – European Citizen Card) und dem Deutschen Institut für Normung e.V. (DIN)

weil der allererste Kindergarten von einer Deutschen gegruendet wurde:

Margarete Meyer Schurz (studierte Lehrerin und Schuelerin des Begruenders der Kindergaerten ueberhaupt - Friedrich Froebel) war mit ihrem Mann (Carl Schurz) ueber's UK nach USA ausgewandert. In Wisconsin liessen sie sich nieder und Margarete gruendete dort 1856 den ersten Kindergarten der USA in Watertown, WI. Zuerst im eigenen Haus, das wurde ihrem Mann jedoch zu laut und so zog sie mit ihrer Kindergarten-Klasse in das leere Haus ihrer Schwiegereltern.

at the time I came to Dayton, OH, there still was the historic general store aside of the salt barn up in Englewood... a true treasurechest - nothing they didn't carry... it's not there any more - and neither am I... today, when hunting for some hard to find hardware, I hit the "big guys" (Lowes, Home Depot) and had to find out they didn't carry what I was looking for... remembered that fairly new Hardware Store in Smyrna, that somehow reminded me of the ole general store up Englewood, OH - and YES, the owner himself helped me, and he did find what I was looking for - so guess where I will start next time - yes here:

dancing the happy dance here: finally I can *see* the keys again - as I'm black-and-white blind these modern keyboards with the very, very thin letters in fading white printed on black keys were nice (this I was typing on till today), but I didn't see what's on these keys any more... (black print on white key won't help)... accidently I ran into these Keys-U-See Large Print Keyboards - they even come with lots of different country layouts - - - I'm happy :)
